1. Description of service

PupOps is a web-based foster coordination platform designed for dog rescue organizations. The Service provides tools for tracking dogs through a rescue pipeline, managing foster home placements, recording medical information, processing adoption applications, and related operational functions.

2. Eligibility and accounts

You must be at least 18 years old to use the Service. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

Organizations may invite additional users (coordinators, foster volunteers, and other team members) to access the Service under the organization's account. The account owner (typically the individual who created the organization) is responsible for managing user access and ensuring all invited users comply with these Terms.

3. Free trial and subscription

PupOps offers a 14-day free trial that does not require a credit card. After the trial period, your account will be placed in read-only mode unless you subscribe to a paid plan. Your data will be retained for 90 days after trial expiration or subscription cancellation.

Paid subscriptions are billed monthly or annually, as selected at the time of purchase. Subscription fees are non-refundable except as described in Section 10. We reserve the right to change pricing with 30 days' advance notice to existing subscribers. Price changes will take effect at the start of your next billing cycle.

4. Acceptable use

You agree to use the Service only for lawful purposes related to the management of animal rescue and foster operations. You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems connected to the Service
• Upload or transmit viruses, malware, or other harmful code
• Use the Service to store or transmit content that is defamatory, obscene, or otherwise objectionable
• Interfere with or disrupt the integrity or performance of the Service
• Resell, sublicense, or redistribute the Service without our written permission
• Use automated tools to scrape, crawl, or extract data from the Service beyond what is available through authorized export features

5. Your data

You retain all ownership rights to the data you upload, enter, or generate through the Service ("Your Data"). We do not claim ownership of Your Data. We will not access, use, or share Your Data except as necessary to provide the Service, comply with law, or as described in our Privacy Policy.

You grant us a limited license to host, store, process, and display Your Data solely for the purpose of operating and improving the Service. This license terminates when you delete Your Data or close your account.

You are responsible for maintaining backups of Your Data. While we take reasonable measures to protect and preserve data stored on our systems, we are not liable for any loss or corruption of Your Data.

6. Data export and portability

You may export Your Data at any time using the export features provided within the Service. Upon cancellation or termination, you will have 90 days of read-only access to export Your Data before it is scheduled for deletion. We will provide advance notice via email before any data is permanently deleted.

7. Intellectual property

The Service, including its design, features, code, documentation, and branding, is owned by PupOps and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

8. Third-party services

The Service may integrate with or link to third-party services (such as payment processors, email providers, or pet listing platforms). We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is subject to their respective terms and policies.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant that any defects will be corrected or that the Service will meet your specific requirements.

The Service is a management and coordination tool. It is not a substitute for professional veterinary care, legal advice, or regulatory compliance. You are solely responsible for the welfare of animals in your care and for compliance with all applicable animal welfare laws and regulations.

10. Limitation of liability

To the maximum extent permitted by law, PupOps and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Cancellation and termination

You may cancel your subscription at any time through your account settings or by contacting us at hello@pupops.io. Cancellation takes effect at the end of the current billing period. Annual subscriptions may be canceled with a prorated refund of the remaining unused months.

We may suspend or terminate your access to the Service if you violate these Terms, if your account is inactive for an extended period, or if we discontinue the Service. We will provide reasonable advance notice before termination except in cases of Terms violations.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Travis County, Texas.
